Terms of Service

AutoHero X is a marketplace that connects customers who need towing, roadside assistance, or auto repair ("Customers") with independent auto businesses and the professionals who work for them ("Businesses," "Professionals").

AutoHero X does not itself provide towing, roadside, or repair services. Businesses and Professionals are independent third parties, not employees, agents, or representatives of AutoHero X. We are not responsible for the quality, safety, timing, legality, or any other aspect of services performed by a Business or Professional, though we may review businesses and mediate disputes as described below.

You must be at least 18 years old and able to form a binding contract to create an account. Businesses represent that they hold any license, registration, or insurance required by law to provide the services they list.

You agree to provide accurate information when registering (including identity, vehicle, and, for businesses, licensing information) and to keep it up to date. You're responsible for activity on your account and for keeping your login credentials secure. Businesses are responsible for the conduct of staff/professionals they add to their account.

We may review, approve, decline, suspend, or deactivate accounts at our discretion — for example, if information can't be verified, a business's license or Stripe payout setup is incomplete, or these Terms are violated.

Customers request a service (and can add notes describing the issue); the Platform routes the request to a nearby, available Business/Professional. Either party may cancel a booking subject to the cancellation terms shown in the app at the time of booking, which may include a cancellation fee. Businesses agree to honor accepted bookings and provide the service they list in good faith.

Payments are processed by Stripe. By adding a payment method or connecting a payout account, you agree to Stripe's terms in addition to ours. Prices shown at booking include the Business's service price plus any applicable platform fee and tax; the total is authorized and captured through Stripe.

Businesses receive payouts, less the platform fee, through Stripe Connect once payouts are enabled on their account. AutoHero X is not a bank and does not hold customer funds outside of the payment flow described above.

Refunds, where applicable, are issued to the original payment method and may be subject to a review of the booking and cancellation reason.

Customers may leave a rating and written review after a booking. Reviews must be honest, based on an actual booking, and free of unlawful, defamatory, or abusive content. We may remove content that violates this or our other policies, and we may display reviews publicly on a Business/Professional's profile.

You agree not to:

• Use the Platform for any unlawful purpose;
• Provide false information about your identity, vehicle, business license, or a booking;
• Attempt to circumvent the Platform to transact outside of it in order to avoid fees;
• Harass, threaten, or discriminate against another user;
• Attempt to gain unauthorized access to the Platform or interfere with its normal operation; or
• Scrape, reverse-engineer, or resell access to the Platform without our permission.

The Platform links to and relies on third-party services, including the Apple App Store, Google Play, and Stripe for payments and payouts. We don't control those services and aren't responsible for their content, availability, or terms. Review their terms before using them.

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Platform will be uninterrupted, secure, or error-free, or that any Business/Professional will be available, suitable, or safe.

To the fullest extent permitted by law, AutoHero X will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Platform or any service performed by a Business or Professional. Our total liability for any claim relating to the Platform is limited to the greater of the platform fees you paid us in the 12 months before the claim, or $100 CAD.

You agree to indemnify and hold AutoHero X harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or, if you're a Business/Professional, the services you provide to Customers.

You may stop using the Platform and delete your account at any time from your account settings, subject to any active bookings being completed or cancelled first. We may suspend or terminate your access if you violate these Terms, pose a risk to other users, or if we discontinue the Platform.

We may update these Terms or the Platform at any time. Material changes will be reflected by updating the "Last updated" date above, and for significant changes we'll provide more prominent notice. Continuing to use the Platform after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Canada and the province in which AutoHero X is registered, without regard to conflict-of-law principles.
